Payment terms

The property of any and all goods supplied will not pass to the buyer until full payment has been made, and that payment is cleared and lodged in the bank account of Amazon Plant Growers.The purchaser holds the goods as bailee for Amazon Plant Growers until full payment is made. Amazon Plant Growers may enter and retake possession of the goods if payment is not made within the agreed terms of payment. The purchaser agrees to pay interest on any or all overdue amounts owed to Amazon Plant Growers should Amazon Plant Growers request that interest be paid.

Risk and ownership

All goods shall be at the risk of the purchaser form the moment they are received by the purchaser. The purchaser agrees to indemnify Amazon Plant Growers for all costs, commissions, and legal expenses whatsoever, arising from the collection of any monies due by the customer to Amazon Plant Growers. Your order if accepted will be on these Terms and Conditions only. Any variations suggested by you will be excluded. Responsibility of Amazon Plant Growers ceases when the material is dispatched to the carrier and thereafter same becomes the liability of the customer. The customer acknowledges by placing an order with Amazon Plant Growers that the customer accepts the risk that some pathogens may be present in the plant material supplied. Whilst Amazon Plant Growers exercise all reasonable care, all warranties, representations, promises, conditions or statement regarding the plant material (whether expressed or implied) including its suitability or fitness, description, quality, grade, composition, style characteristics, standard or sample are hereby expressly excluded and shall not bind Amazon Plant Growers in any way unless expressly set forth in this or another agreement signed by Amazon Plant Growers. In this agreement Customer includes its servants, agents and employees.

Exclusion of liability

Any disclaimers and exclusions of liability in these terms and conditions shall not apply to any damages arising from death or personal injury caused by our negligence. These disclaimers and exclusions shall be governed by and construed in accordance with Australian law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with Australian law.
